As for the constitution - as the new President of Israel use to say "Yes, and No". The Soviet Union had a beautifully written constitution that was worthless, and so will the Iraqi constitution. On the other hand England managed to develop a democracy (which in my mind is better than the American version) without a constitution. However in the American case the constitution is very important - not always in real-time since it didn't prevent many injustices (Slavery will be the most famous one). But in the most part it is guide which help the system to correct itself (as it is happen now with the evil of "enemy combatant" . Moreover, it seems to me that for the American system, with its lack of subtlety, the constitution is crucial document.
As for Israel, I think that an attempt to write a constitution now will be a disaster - So I guess we are in agreement on this issue.
